Not so fast
May. 8th, 2008 07:28 pmAre you sick of hearing abou the damn house hunting yet?
Sure, they accepted the offer with the following conditions:
Property shall be accepted "as is" with $500.00 towards any repairs found at inspection
1000.00 escrow
We do not have a remedy to go after seller for things that they knew about and didn't disclose, repair, etc.
Somebody knows something.
Not sure what we will do now. I am so tired of this. If I didn't hate this place so much, I would start seriously considering buying it. It still might come down to that. At least here, I know the floors are hardwood under the carpets, just would need to have them refinished.

Date: 2008-05-09 03:11 am (UTC)I think someone died but not sure. The house is empty.
I told our agent to counter their counter offer back to our orig. counter offer but giving them the increased escrow.

Date: 2008-05-09 03:43 am (UTC)I am ok with walking away - even though it means no Cheleland or Safeway Annex and separate sewing room....

Date: 2008-05-09 06:02 am (UTC)Emotionally, I have walked away from the house so I won't take to my bed if they reject our terms (or we have to reject their terms).
Off to see what else is out there.

Date: 2008-05-09 06:38 am (UTC)Figured I didn't have the furniture for the 273K house but might still consider the 253K with the built in 57 inch tv.
I think the listing agent is feeding the fire and didn't like getting played by us during her open house.

Date: 2008-05-09 11:18 am (UTC)I'm not 100% sure what that means. Does that mean if a lot more than $500 worth of needed repairs is found at inspection you can't get out of the deal? If so, yeah.. run. Or does the "as is" refer to no warranty? If it's that, then find a real good inspector and make sure he knows you suspect something.
Or - just read your other comments - keep looking. It's a buyers market. And good luck.

Date: 2008-05-09 01:38 pm (UTC)However, with our current home, the previous owners had had a recent inspection done for a contract that fell thru at the last second (buyer's divorce didn't go thru)- less than 30 days before our contract and so, part of their counter was for us to accept the previous inspection, so essentially, it was an *as is* kinda thing. They weren't hiding anything and we haven't gotten burned... but, we could easily tell the house had been meticulously cared for (you should see the binder full of appliance instructions, warranties, etc) AND we had a copy of the month old inspection. Basically, it saved us $$ and time so it was worth it.
I would do some investigating and see what you can turn up about the house because it does indeed, sound as if they are hiding something. The sellers of our Md house failed to disclose there was a serious leak in the master bathroom shower and they simply caulked over the tiles to make everything fresh and pretty. 2 years later while I was showering upstairs, my kitchen ceiling started raining because of the ongoing leak. The bitch of it was there was NO WAY for us to prove they had covered it up even though the contractor we used REMEMBERED the house, the problem, and the fact the man who owned it was TOO CHEAP to have it fixed correctly. (Too Cheap was the exact phrase we heard from every person on the block any time his name came up, so we knew the contractor had it right).
Over $8K later.... we had a gorgeous shower... and absolutely no recourse to go after the previous owners.
I'm so sorry to hear that there have been so many problems with this.... it is so stressful to buy a home. *hugs*
